YOUR CONSENT AND CHANGES TO THIS POLICY

By using our site and/or by using our services, you consent to our Privacy Policy and our collection, use, and disclosure of your information in accordance with it. If we make any material changes to our policies, we will notify you by posting notice of the changes to this website. Your use of the site after the changes constitutes your agreement with regard to information collected from you in the past and in the future.

For visitors to our website, subscribers to our newsletters, clients and prospective clients of our service (collectively referred to as a “User” or “Users”), we log standard technical information such as your IP address, interactions on different pages, and browser information. We use this information to help diagnose problems with our service, to administer our website and in reporting capacities as identified below to companies with whom Saviynt works, including its clients, partners, etc. For example, your IP address may be used to help identify you and your account information and to gather demographic information, or to maintain an aggregated log of click activity on our website.

Our site uses cookies to keep track of your account. We also use cookies to deliver content specific to you.

SAVIYNT’S USE OF INFORMATION

We may use your contact information to send you information about our company or our advertisers; however, you may opt out of receiving such mailings (see the Client Prospects and Subscribers sections below). We use financial information to bill you for products and services. Demographic, usage and profile data are also collected at our site, and may be used in the course of reporting. Anonymous user data (such as IP addresses, and/or their IP-location information, if available) may be utilized within aggregate traffic reporting to our clients. Additionally, certain information provided at user-registration (such as a user title) may be made available to clients within research reports, although no personally identifiable information (such as names, phone numbers, or email addresses) will be reported.

We use this data to tailor your experience at our site, to deliver content that we think you might be interested in, to display the content according to your preferences and we may share aggregate information about our users with third parties such as advertisers or clients submitting press releases to Saviynt.

HOW DO WE PROTECT YOUR INFORMATION?

We have in place industry standard security measures to protect against the loss, misuse or alteration of the information under our control, including through the use of physical, organizational, and technological measures and appropriate training of employees. However, it is possible that any information transmitted via the Internet may be intercepted by unknown third parties. We, therefore, encourage you to carefully ensure security through virus screening software, browser settings, the setting of passwords that are known only to you and are difficult to guess, and other security measures available to individuals and/or companies.

If you’re a user or visitor in the European Economic Area these rights also apply to you:

For the purposes of applicable EU data protection law (including the General Data Protection Regulation 2016/679 (the “GDPR”), we are a ‘data controller’ of your personal information.

DO WE USE COOKIES?

Yes. Cookies are small files that a site or its service provider transfers to your computer’s hard drive through your Web browser (if you grant permission) that enables the sites or service provider’s systems to recognize your browser and capture and remember certain information. We use cookies to compile aggregate data about site traffic and site interaction so that we can offer better site experiences and tools in the future. We may contract with third-party service providers to assist us in better understanding our site visitors. These service providers are not permitted to use the information collected on our behalf except to help us conduct and improve our business.

DO WE DISCLOSE ANY INFORMATION TO OUTSIDE PARTIES?

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information collected from visiting our websites saviynt.com. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

Saviynt may also disclose your personal information, the contents of your communications and/or your contact and financial information if required to do so by law, with your consent or in the good faith belief that such action is necessary:

  • To conform to the edicts of the law or comply with a legal process served on Saviynt;
  • To protect and defend the rights or property of Saviynt or others; or
  • To assist, under exigent circumstances, in the investigation of securities law violations or other investigations.

It is possible that as we continue to develop our business, Saviynt might be acquired. In such a transaction, your information may be transferred to the acquiring entity.

Additionally, we may store or process your personal information on servers in Canada and/or the United States. As a consequence, your personal information may be accessed by the courts, law enforcement and national security authorities of those jurisdictions in accordance with applicable laws.

By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

All information you provide to us is stored on our secure servers. Where we have given you (or where you have chosen) a password and/or user ID which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share your password or user ID with anyone.

Unfortunately, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our site; any transmission is at your own risk. EU-U.S. AND SWISS-U.S. DATA PRIVACY FRAMEWORKS

Saviynt participates in and complies with the EU-U.S. Data Privacy Framework (“EU-U.S. DPF”), the UK Extension of the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) (collectively, “DPF”) as set forth by the U.S. Department of Commerce regarding the collection, use and retention of personal information from European Union member countries, the United Kingdom, and Switzerland.

As a DPF participant, Saviynt is committed to and has certified to the U.S. Department of Commerce that it adheres to: (i) the EU-U.S. Data Privacy Framework Principles with regard to the processing of personal information received from the European Union; (ii) the UK Extension to the EU-U.S. Data Privacy Framework Principles with regard to the processing of personal information received from the United Kingdom; and (iii) the Swiss-U.S. Data Privacy Framework Principles (collectively, the “DPF Principles”) with regard to the processing of personal information received from Switzerland. If there is any conflict between the terms in this Privacy Policy and the DPF Principles, the DPF Principles shall govern. To learn more about the DPF program, and to view our certification, please visit: https://www.dataprivacyframework.gov/. https://www.dataprivacyframework.gov/s/participant-search. Our commitments to the DPF program are subject to the investigatory and enforcement powers of the US Federal Trade Commission.

We may collect, use, and disclose personal information that is subject to the DPF Principles with our third-party service providers. We restrict their access, use and disclosure of personal information in compliance with our DPF obligations. Saviynt may be liable under the DPF if these third parties process such personal information in a manner inconsistent with the DPF, unless Saviynt proves that it is not responsible for the event giving rise to the damage.

You have the right to request access to personal information received by Saviynt in reliance on the DPF, and to exercise choice in limiting Saviynt’s use and disclosure of such information. If you are interested in exercising your rights and choices, please contact us at the address, phone number, or email address listed below.

Saviynt does not use or share the personal information we collect for purposes other than the purposes we disclose to the relevant individuals. We do not use clinical trial participants’ personal information for purposes other than those described in the informed consent form and the study protocol for the relevant clinical trial. The informed consent form sets out choices trial participants may have under laws and regulations that govern clinical trials, such as the choice to withdraw consent for further participation in a clinical trial.

Saviynt does not use personal information for purposes other than those described in this Privacy Policy. Website visitors, clients, and subscribers have the ability to opt of receiving marketing communications, as described in this Privacy Policy.

We may be required to disclose personal information received by us in reliance on the DPF in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In compliance with the DPF Principles, we encourage you to contact us at any time as specified in the Contact Us section below with questions, concerns, or complaints about our privacy practices and participation in the DPF. You may also refer a complaint to your local data protection authority and Saviynt will work with them to resolve your concern.

Saviynt has further committed to refer unresolved DPF complaints to JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please visit: https://www.jamsadr.com/DPF-Dispute-Resolutionhttps://www.jamsadr.com/eu-us-data-privacy-framework for more information or to file a complaint. The JAMS services are provided at no cost to you. If neither Saviynt nor JAMS resolves your complaint, you may have the right to invoke binding arbitration under certain conditions. To learn more about this option, visit the DPF’s “How to Submit a Complaint” page.

Please note that the foregoing processes apply only to the resolution of disputes regarding personal information received by Saviynt under the DPF. All other disputes that you may have with Saviynt, or any agents, representatives, agencies, officers, directors, or employees, must be resolved in accordance with the terms and conditions of any applicable websites, mobile apps, email newsletters, email subscriptions or other digital properties owned or controlled by Saviynt.

HOW YOU CAN ACCESS YOUR PERSONAL INFORMATION

You are also entitled to ask us to port your personal information (i.e. to transfer in a structured, commonly used and machine-readable format, to you), to erase it, or restrict its processing. You also have rights to object to some processing that is based on our legitimate interests, such as profiling that we perform for the purposes of direct marketing, and, where we have asked for your consent to process your data, to withdraw this consent as more fully described below.

These rights are limited in some situations – for example, we can demonstrate that we have a legal requirement to process your personal information. In some instances, this means that we may retain some data even if you withdraw your consent.

Where we require your personal information to comply with legal or contractual obligations, then provision of such data is mandatory: if such data is not provided, then we will not be able to manage our contractual relationship with you, or to meet obligations placed on us. In all other cases, provision of requested personal information is optional.

If you have unresolved concerns you also have the right to complain to data protection authorities. The relevant data protection authority will be the data protection authority of the country: (i) of your habitual residence; (ii) of your place of work; or (iii) in which you consider the alleged infringement has occurred.

Both personal information and personal data have the same meaning in the context of this Privacy Policy.
